End User License Agreement

PLEASE READ THIS END USER LICENSE AGREEMENT ("AGREEMENT") CAREFULLY BEFORE USING THE TRL / ACTIVE APPLICATION ("APP").

BY CREATING AN ACCOUNT, ACCESSING, OR USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY THIS AGREEMENT. IF YOU DO NOT AGREE, YOU MUST NOT USE THE APP.

1. No Medical Advice

TRL / ACTIVE is not a medical device and does not provide medical advice. All information, content, recommendations, coaching, feedback, and output provided by the App are for general informational and educational purposes only. The App is not intended to diagnose, treat, cure, prevent, or mitigate any disease, illness, medical condition, or injury. You should always seek the advice of a licensed physician or qualified healthcare provider before beginning any exercise, fitness, nutrition, or wellness program, or if you have any questions regarding a medical condition. Never disregard, avoid, or delay seeking professional medical advice because of information provided by the App.

2. Assumption of Risk

You acknowledge that physical activity and fitness training involve inherent risks, including but not limited to injury, illness, disability, or death. You voluntarily and expressly assume all risks associated with your use of the App, including any reliance on information or recommendations provided.

3. User Responsibility

You are solely responsible for: determining whether any activity, workout, or suggestion is appropriate for you; monitoring your own physical and mental condition; stopping any activity that causes pain, dizziness, shortness of breath, or discomfort; seeking professional medical care when necessary. The App does not replace professional supervision, training, or medical care.

4. No Warranties

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. TRL / ACTIVE disclaims all warranties, including but not limited to: merchantability; fitness for a particular purpose; accuracy, completeness, or reliability of content; non-infringement.

5. Limitation of Liability

To the maximum extent permitted by law, in no event shall TRL / ACTIVE, its owners, affiliates, employees, contractors, or licensors be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use of the App. This includes, without limitation: personal injury; medical complications; lost profits; data loss; emotional distress; even if advised of the possibility of such damages.

6. Indemnification

You agree to defend, indemnify, and hold harmless TRL / ACTIVE and its affiliates from any claims, damages, losses, or expenses arising from: your use or misuse of the App; your violation of this Agreement; your reliance on App content.

7. No Emergency Use

The App is not intended for use in emergencies. Do not use the App for medical emergencies. If you believe you are experiencing a medical emergency, call 911 (or your local emergency number) immediately.

8. AI Limitations

You acknowledge that TRL / ACTIVE uses automated and artificial intelligence systems that may produce inaccurate, incomplete, or unexpected outputs. You agree not to rely solely on the App for decisions affecting your health or safety.

9. Subscription & Billing

TRL / ACTIVE offers an auto-renewable monthly subscription ("TRL/Active Pro") that provides access to AI coaching, personalized workout plans, and nutrition guidance. Payment is charged to your Apple ID account at confirmation of purchase. The subscription automatically renews each month unless you cancel at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time in your Apple ID Account Settings. All subscription fees are non-refundable except as required by applicable law.

10. Termination

TRL / ACTIVE may terminate or suspend your access at any time for any reason, including violation of this Agreement.

11. Governing Law

This Agreement shall be governed by the laws of the State of California, without regard to conflict of law principles.

12. Entire Agreement

This Agreement constitutes the entire agreement between you and TRL / ACTIVE regarding use of the App.
